On October 13, 2020, Mr. Lamarche (the “Plaintiff”) commenced a proposed class proceeding against Synta Technology Corporation of Taiwan, Synta Canada International Enterprises Ltd., Suzhou Synta Optical Technology Co., Ltd., Nantong Schmidt Opto-Electrical Technology Co. Ltd., SW Technology Corporation, Sky-Watcher USA, Pacific Telescope Corp., Celestron Acquisition, LLC, Celestron International, Olivon Manufacturing Co. Ltd., Olivon International Enterprise Inc., Olivon USA, LLC and Ningbo Sunny Electronic Co., Ltd. (the “Defendants”).

The proposed class proceeding involved allegations that these telescope companies engaging in anticompetitive actions to manipulate prices and allocate markets for telescopes sales in Canada. It is also alleged that as a result of this price-fixing, purchasers of consumer telescopes have been overcharged millions of dollars for telescopes since at least 2005.

The Defendants deny all of the allegations made against them in the proceeding.

The proceeding was never advanced to certification and, as a result, the Ontario Superior Court of Justice has ordered that, effective April 26, 2022, the proceeding is dismissed for delay pursuant to s. 29.1 of the Class Proceedings Act, 1992.

TAKE NOTICE THAT while this proposed class action was pending, limitation periods (time limits) for starting individual claims against the Defendants regarding matters alleged in proposed class proceeding were suspended. Upon the expiry of a limitation period, you may lose any right you might have had to sue. If you wish to pursue your own action against the Defendants, you should consult with your own lawyer, as you may need to take steps to protect your rights.
