CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against Lumber Liquidators (Canada), Inc. and Lumber Liquidators, Inc. on behalf of all persons, entities or organizations resident in Canada who purchased one or more Chinese-produced laminate flooring products from Lumber Liquidators or who own homes in Canada in which these Chinese-produced laminate flooring products were installed.

The class action involves Lumber Liquidators express representation that their Chinese-produced laminate flooring are compliant with the California Air Resources Board (“CARB”) formaldehyde emissions standards (“CARB Standards”) and as “meet[ing] the highest quality and environmental standards”, when in fact independent testing revealed that their Chinese-produced laminate flooring contain six (6) to seven (7) times in excess of CARB’s Standards and some samples were close to twenty (20) times in excess thereof. These conditions present a serious safety hazard due formaldehyde's gradual adverse effect on health.

The list of products that have been tested and found to exceed the CARB Standards for formaldehyde emissions is the following:

f) 12 mm Dream Home Ispiri Poplar Forest Oak Laminate Flooring;
g) 12 mm Dream Home Kensington Manor Antique Bamboo Laminate Flooring;
h) 12 mm Dream Home Kensington Manor Cape Doctor Laminate Flooring;
i) 12 mm Dream Home Kensington Manor Fumed African Ironwood Laminate Flooring;
j) 12 mm Dream Home Kensington Manor Glacier Peak Poplar Laminate Flooring;
k) 12 mm Dream Home Kensington Manor Golden Teak Laminate Flooring;

The class action is seeking the following as damages:

(a) The purchase price [or the overpayment thereof] of the Flooring Products,
(b) The amounts paid to have the Flooring Products installed,
(c) Out-of-pocket expenses for repairs and replacements, including future costs of repair and replacements,
(d) The diminished value of their Flooring Products,
(e) Pain and suffering, stress, trouble and inconvenience; and
(f) Punitive, exemplary and aggravated damages.
