JUUL e-Cigarettes Canadian Class Action
CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against JUUL Labs, Altria Group, and Philip Morris for their JUUL e-cigarettes.
These companies are preying on youth to recruit replacement smokers for financial gain and knowingly withholding information from consumers, specifically teenage users, about the addictive nature of JUULs.
These companies have been successful in luring teenagers to their JUUL products and in so doing, are getting “customers for life”. Schools are struggling with their students’ vaping addiction.
There are currently six JUULpod flavours offered for sale in Canada: Virginia Tobacco, Mint, Mango, Vanilla, Fruit, and Cucumber. All six flavours are currently available in the five, three and 1.5 percent nicotine strengths at convenience stores, vape shops, and on JUUL Labs' e-commerce site at JUUL.ca.
The sales campaigns for JUULs – now hugely popular with teenagers – are at the heart of a federal investigation in the United States into whether the company intentionally marketed its devices to youth. The U.S. Food and Drug Administration (FDA) has announced a major crackdown on the vaping industry and in particular, on the trendy JUUL devices.
These companies have been luring teenagers to try the JUUL products and have introduced many to nicotine. The FDA also demanded that Juul Labs turn over company documents about the marketing and research behind its products, including reports on focus groups and toxicology, to determine whether Juul is intentionally appealing to the youth market despite its statements to the contrary and despite knowing its addictive potential.
The makers of JUUL e-cigarettes have touted their products as cessation tools for adult tobacco smokers, yet, problematic usage has exploded among adolescents. JUUL devices were emphasized as particularly problematic because of their high nicotine content, high addiction potential and flash drive-like design.
As a result of this misconduct, consumers were harmed and suffered actual damages in purchasing and/or using JUUL e-cigarettes and unknowingly exposing themselves to health risks.
The class action includes all persons in Canada who have purchased and/or used JUUL Products, as well as legal guardians of JUUL users under 18.
