Graphene Masks Lung Toxicity Class Action



1. On April 6, 2021, the Plaintiff instituted an Application to Authorize the Bringing of a Class Action and to Appoint the Plaintiff as Representative Plaintiff (the “Application for Authorization”) in the Superior Court of Quebec, district of Montreal, under file number 500-06-000688-149, on behalf of the following class:

• All persons residing in Quebec who wore a face mask coated with nanoform graphene materials (the “Graphene Masks”) or any other group to be determined by the Court;

2. On January 24, 2022, the Superior Court of Quebec authorized the Plaintiff to discontinue the legal proceedings, thereby putting an end to the class action;

BE AWARE that now that the Court has allowed the discontinuance, the class action is terminated. Limitation periods (i.e. prescription) are no longer suspended. Therefore, class members will be required to pursue their own legal claims, should they so desire.

In this case, the period during which an action is allowed had possibly begun to run until April 6, 2021, and the remaining period is therefore reduced accordingly.

CONSUMER LAW GROUP has launched a class action lawsuit on behalf of all persons residing in Quebec who wore a face mask coated with nanoform graphene materials (the “Graphene Masks”).

The Graphene Masks known at present include those under code SNN200642, which are made in China and sold and distributed by Métallifer, a Quebec-based company that was selling and distributing the masks – they are recognizable as the grey and blue masks.

On March 26, 2021, three ministries of the Quebec government, education, families, and higher education, sent out a directive to school boards, daycares, and health networks that Graphene Masks that had been distributed to them may be dangerous for the lungs as they could contain a potentially toxic material.

There have been a number of comprehensive reviews on the potential toxicity of graphene dating back over 10 years ago.

The Graphene Masks were falsely represented as safe for humans to wear on their faces, despite a wealth of knowledge to the contrary. Particularly troublesome is that the Graphene Masks were being distributed in schools and healthcare settings where there are more children and elderly, who are more vulnerable to lung injury and need to be especially careful about what they breathe in.
