CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against Panasonic, Sanyo, Taiyo Yuden, NEC Tokin, Kemet Electronics, Matsuo Electronics, Toshin Kogyo, Vishay Intertechnology, Nichicon Corporation, Nippon Chemi-Con, Hitachi Chemical, Rubycon, Elna, TDK-EPC, AVX Corporation, Samsung Electro-Mechanics, and Rohm on behalf of all purchasers of aluminum, tantalum and/or film capacitors (a “Capacitor”) and/or a Capacitor Product containing a Capacitor.

“Capacitor(s)” are electronic components that are primarily used to store an electrical charge and serve as a fundamental component of electrical circuits. Virtually every electrical circuit contains one or more capacitors.

“Capacitor Products” are products containing an aluminum, tantalum and/or film capacitor when purchased. These multifarious products (containing electrical circuits and thus, Capacitors) are present in virtually all electronics - they range from the cheapest household appliances to personal computers to multi-million dollar machinery and vehicles.

For decades, the Respondents have been the world’s leading manufacturers and direct competitors within the global Capacitors industry and they have been using this monopolistic power to unlawfully fix, raise, maintain and/or to stabilize prices of Capacitors and/or to reduce their market availability without adequate justification.

By reason of this anti-competitive and unlawful conduct, the Petitioner and the members of the class have paid artificially inflated prices for Capacitors and/or Capacitor Products than they would have paid in a competitive market, causing damages upon which they wish to claim.

The class action lawsuit identifies the group of affected persons as:

All residents in Canada who purchased either an aluminum, tantalum and/or film capacitor (a “Capacitor”) manufactured by a Respondent and/or a Capacitor Product containing a Capacitor manufactured by a Respondent, or from any predecessors, parents, subsidiaries, agents or affiliates thereof, at any time between January 1, 2005 and the present (the “Class Period”), or any other group to be determined by the Court.
