CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Mitsubishi Canada Limited and Mitsubishi Fuso Truck of America, Inc. (“Mitsubishi Fuso”) relating to a defective emissions control system in all model year 2012-2016 Mitsubishi Fuso Canter trucks.

The vehicles involved are:

- Mitsubishi Fuso Canter trucks having the BlueTec® SCR technology (model years 2012, 2013, 2014, 2015, 2016).

The proposed class action is based on allegations that Mitsubishi Fuso sold certain trucks with BlueTec® technology having defects causing operational failures, as well as transmission issues. The defects on these trucks resulted in repeated failures of:

- Diesel Exhaust Fluid (DEF) handlers,
- fuel injectors,
- crank case pressure sensors and breather,
- catalytic converter muffler,
- DEF tank internal sensor,
- engine protection system,
- EEC programming, and
- other problems that caused the trucks to stall or not restart.

The trucks also have a transmission defect, causing the truck’s transmission to jerk, make noise or not shift properly.

Mitsubishi Fuso marketed the engines equipped with BlueTec® technology as one that reduces nitrogen oxides (NOx). However, the trucks were defectively designed, tested, assembled and manufactured. The BlueTec® technology has rendered the trucks defective for prolonged periods of time, resulting in thousands of dollars in replacement vehicle costs, lost deliveries, and other expenses.

A class action lawsuit was filed in the United States claiming that Mitsubishi Fuso manufactured and sold trucks with BlueTec® technology which have defects causing emissions-related engine and after-treatment system problems and transmission issues. A $17.5 million cash settlement was reached in the U.S., including payments of up to $10,000 per truck, as well as, a fair market value Buyback Option and Trade-in Credit for qualifying vehicles.

Owners and lessees have suffered damages as a result of their purchase of these vehicles, including but not limited to: (a) out-of-pocket losses and future attempted repairs, (b) back-up rental and use costs, (c) diminished value of the vehicle, and (d) lost earnings.
