CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against General Motors relating to the defective Ecotec 2.4L engines in certain of its vehicles, which are prone to excessive oil consumption and/or piston or engine damage.

The vehicles involved are:

- Chevrolet Equinox 2.4 Litre Ecotec (model years 2010, 2011, 2012, & 2013)
- GMC Terrain 2.4 Litre Ecotec (model years 2010, 2011, 2012, & 2013)

It is alleged that these GM vehicles burn through motor oil at an alarming rate causing engine damage and other serious issues. In addition to burning excessive oil, the vehicles have an “Oil Pressure Warning” system that is supposed to alert drivers to low oil levels, which also fails to work.

Although several features of the vehicles’ engines contribute to the oil consumption defect, the primary cause is faulty piston rings, including both “compression” and “oil” rings. The piston rings are prone to premature wear, which can result in a loosening of the seal surrounding the pistons and oil flowing into the engine’s combustion chamber. The oil consumption defect requires the driver to replenish the vehicle’s oil more frequently. Otherwise, the engine’s oil pressure may drop to a dangerously low level, causing engine damage or failure.

GM knew, prior to 2010, that these vehicles contained one or more design and/or manufacturing defects, including, but not limited to, the engine defect that cause them to be unable to properly utilize the engine oil and, in fact, to improperly burn off and/or consume abnormally high amounts of oil.

A settlement has been reached in the United States relating to the excessive oil consumption and the related issues or piston and/or engine damage; however, Canadians have not been equally compensated.

In the U.S., GM had issued Special Coverage Adjustments (“SCAs”) for the above vehicles, which extended the warranties to cover piston replacement and reimbursed certain out-of-pocket expenses relating to piston replacement; however, Canadians have not benefited from the same offering.

No recalls have ever been issued in Canada relating to the design defect – the place to look for recalls can be found on the Transport Canada Motor Vehicle Safety Recalls Database and Transport Canada provides a Defect Complaint Form where you can report a safety-related defect.
