On September 19, 2014, Consumer Law Group commenced a class action against Sylvania relating to certain statements made regarding their premium halogen automotive headlights.

The following brands are the subject of the litigation:

• SilverStar ULTRA, SilverStar, XtraVision, or Cool Blue replacement headlight capsules
• SilverStar, XtraVision, or Cool Blue sealed beam headlights
• SilverStar fog or auxiliary lights

On May 18, 2016, the Ontario Superior Court of Justice and the Superior Court of Quebec scheduled Motions for the Approval of the Settlement Agreement for August 30, 2016 at 9:15 AM at the Montreal Court House located at 1, Notre-Dame St. East, Montreal, Quebec and August 31, 2016 at 9:30 AM at the L’Orignal CourtHouse located at 1023 King St., L'Orignal, Ontario.

CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against Osram Sylvania on behalf of individuals who have purchased premium halogen automotive headlights sold under the brand names SilverStar, SilverStar Ultra, XtraVision, and Cool Blue.

The class action involves the deceptive, misleading, false, and unfair advertising of the SilverStar, SilverStar Ultra, XtraVision, and Cool Blue premium halogen automotive headlamps as (i) being brighter, (ii) providing a wider beam, and (iii) enabling the user to see further down the road than standard automotive lighting products. However, Osram Sylvania omits to adequately disclose to consumers that their comparative “studies” are valueless and scientifically unsound.

Contrary to the representations made, the SilverStar, SilverStar Ultra, XtraVision, and Cool Blue premium halogen automotive headlights are no different than standard automotive lighting products in terms of visibility. In addition, Osram Sylvania fails to disclose that their Automotive Lighting Products have a significantly reduced life span when compared to regular halogen automotive lighting products.

As a result, consumers were induced into purchasing Automotive Lighting Products which do not and cannot live up to their promised results and reasonable expectations, thereby causing them economic damages equal to the purchase price of these premium halogen headlamps.

The class action lawsuit identifies the group of affected persons as:

All residents in Canada who have purchased: (i) SilverStar ULTRA, SilverStar, XtraVision, or Cool Blue replacement headlamp capsules; (ii) SilverStar, XtraVision, or Cool Blue sealed beam headlamps; or (iii) SilverStar fog or auxiliary lights (collectively, “Automotive Lighting Products”), or any other group to be determined by the Court.
