On May 20, 2011, Consumer Law Group commenced a class action against Ford relating to allegations of quality, design, manufacturing and reliability defects in the model years 2003-2007 heavy Ford trucks and vans equipped with Navistar’s 6.0-litre PowerStroke diesel engines.

On February 9, 2016, the parties reached a proposed national settlement. A copy of the Canadian Settlement Agreement is available here:

On June 3, 2016, the Ontario Superior Court of Justice and the Superior Court of Quebec scheduled Motions for the Approval of the Settlement Agreement for October 26, 2016 at 10:00 A.M. at the L’Orignal Court House located at 59 Court St., L'Orignal, Ontario and November 15, 2016 at 9:30 A.M. at the Montreal Court House located at 1, Notre-Dame St. East, Montreal, Quebec in room 2.08.

CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against Ford and Navistar on behalf of individuals who currently own or lease or have previously owned or leased a Ford vehicle equipped with Navistar’s 6.0 Litre diesel engine, (commonly referred to as the Power Stroke V8 Turbo diesel engine) for the model years 2003 through 2007.

The class action involves allegations made by the plaintiffs of serious and pervasive design defects with the engines powering the Ford vehicles which were designed and manufactured by Navistar that are alleged by the plaintiffs to render the engines and vehicles themselves unmerchantable and unsuitable for use.

Such problems are alleged to include:

- Loss of engine power
- Blown head gasket
- Warped/disfigured head bolts
- Oil cooler failure
- Engine Gas Recirculation (EGR) cooler failure
- Coolant entering the engine’s ventilation system

The trucks involved are:

• 2003-2007 Ford F250 Super Duty
• 2003-2007 Ford F350 Super Duty
• 2003-2007 Ford Excursion

During the warranty period (60,000 kilometres or 3 years and 100,000 kilometres or 5 years), the plaintiffs alleged Ford would refuse to authorize necessary major engine repairs or engine replacements, instead only authorizing cheaper services (like injector replacements) knowing that they would merely serve as a temporary measure until the warranty expired.

Ford has denied the claims and allegations made in the proceedings and denied any liability. The settlement does not constitute an admission of liability by Ford, or evidence against Ford, or evidence of the truth of any of the allegations made in the proceedings.
