Notice of Settlement Approval

If you purchased DIAL COMPLETE®, you may be eligible to receive a payment from a class action settlement.

Superior Court of Quebec file number: 500-06-000577-110.

A hearing to approve the Settlement took place on May 4, 2021. The Superior Court of Quebec approved the Settlement. The claims process outlined in the Settlement Agreement has now commenced.

If you would like to claim a benefit under the Settlement, you must submit a Claim Form by August 1, 2021. Claim Forms can be found on the Settlement Website by clicking HERE.

Please note that in accordance with the Regulation respecting the percentage withheld by the Fonds d’aide aux actions collectives and the Judgment of the Superior Court of Quebec, 2% of every Settlement Payment will be withheld and remitted to the Fonds d’aide aux actions collectives, irrespective of where the Eligible Claimant resides.

**SETTLEMENT ALERT**

If you purchased DIAL COMPLETE®, you may be eligible to receive a payment from a class action settlement.

A proposed Settlement has been reached in a legal Action regarding DIAL COMPLETE® antibacterial soap formulated with the active ingredient triclosan and/or using the “Kills 99.99% of Germs” advertising claim.

The Settlement Approval Hearing is scheduled for May 4, 2021 at 9:00 AM at the Montreal Courthouse, 1 rue Notre Dame East, Montreal.

If the Settlement is approved, every Eligible Claimant will receive CAD $0.36 for each bottle of Dial Complete purchased in Canada before January 29, 2021, up to a maximum of 30 bottles, subject to the limitations and deductions set out in the Settlement. No proof of purchase is required. If the total amount claimed by all Eligible Claimants exceeds CAD $172,000, then each Settlement Payment will be reduced on a pro rata basis.

If you do not want to be legally bound by the Settlement, you must opt out of the Settlement Class by March 15, 2021. If you do not opt out, you may object to the Settlement by March 1, 2021.

** IMPORTANT UPDATE **

Please be aware that the Class Action relating to the product Dial Complete Antibacterial Hand Soap issued before the Superior Court of Quebec is being suspended pending a decision by the U.S. District Court of New Hampshire regarding a similar Class Action.

The hearing in the U.S. Court is likely to take place before the end of the year 2016.

There will be a further update of the present case when new information becomes available.

CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against Henkel on behalf of individuals who have purchased the product Dial Complete Antibacterial Hand Wash.

The class action involves the deceptive, misleading, false, and unfair advertising of Dial Complete Antibacterial Hand Wash soaps’ efficacy at eliminating “disease-causing germs” and “illness-causing bacteria”. In addition, Dial Complete contains 0.46% Triclosan, which is in excess of Health Canada’s established Cosmetic Ingredient Hotlist which dictates a maximum concentration of 0.3%.

In fact, the available data to date does not support the ability of Triclosan to reduce infectious disease symptoms or bacterial counts on the hands when used at the concentrations commonly found in consumer antiseptic hand soaps. At this time, there is no independent and reliable evidence to suggest Triclosan in antibacterial soaps provides any benefit over washing with regular soap and water. To the contrary, there is the possibility that using Dial Complete over a long period of time may actually cause antibiotic resistance.

As a result, consumers were charged a premium price for the purchase of Dial Complete over and above regular soap, thereby causing them economic damages.

The class action lawsuit identifies the group of affected persons as:

All residents in Canada who have purchased DIAL COMPLETE® Antibacterial Hand Wash (“Dial Complete”), or any other group to be determined by the Court;
