Apple iPod Refund & Hearing Loss National Class Action

CONSUMER LAW GROUP has launched a class action lawsuit against Apple on behalf of adults and minors who have purchased or used iPods from the years 2001 to 2007.

The class action alleges that, with respect to minors, Apple has violated the Federal Hazardous Products Act by selling a product capable of reaching sounds in excess of 100 decibels. Persons who were minors (under 18 years old) when they purchased an iPod should be entitled to a full refund of the purchase price, as well as, compensation for any hearing loss that they may have suffered.

The class action alleges that, with respect to adults, Apple has sold a dangerous device without adequate warnings on the possible risk of hearing loss when their iPods are used in places that have background noise and where the person uses the earbuds that are sold with the iPod, instead of noise-cancelling earphones.

The Apple iPods involved include all of the generations of:

• Classic
• Shuffle
• Nano
• Mini
• Touch

The class action lawsuit identifies the group of affected persons as:

Adults
o All residents in Canada who were the age of majority when they purchased and/or used any IPOD designed, manufactured, distributed, sold, or otherwise put onto the marketplace by the Respondents, or any other group to be determined by the Court;

Alternately (or as a subclass)

o All residents in Quebec who were the age of majority when they purchased and/or used any IPOD designed, manufactured, distributed, sold, or otherwise put onto the marketplace by the Respondents, or any other group to be determined by the Court;

Minors
o All residents in Canada who were minors when they purchased and/or used any IPOD designed, manufactured, distributed, sold, or otherwise put onto the marketplace by the Respondents, or any other group to be determined by the Court;

Alternately (or as a subclass)

o All residents in Quebec who were minors when they purchased and/or used any IPOD designed, manufactured, distributed, sold, or otherwise put onto the marketplace by the Respondents, or any other group to be determined by the Court;
